Thayne Town Council Meeting
May 13th, 2010

Present: Mayor Don Aullman. Councilmember’s; Terry Titensor, Todd Luthi, and Jim Bartleson. Clerk Joan Jensen.

Mayor Aullman called the meeting to order. Ron Coleman led us in the Pledge of Allegiance.

Mayor Aullman asked the council for approval of the previous read minutes of April 14th, 2010. Councilman Titensor made the motion to approve the minutes. Councilman Luthi seconded the motion.

The Thayne Volunteer Fire Department was first on the agenda. Chief Turner addressed the council. Chief Turner informed the council that they had the elementary school children at the fire station to teach them about the fire department. Chief Turner reported to the council regarding the status of the training of the volunteers and the cadets. The cadet program started out with six people and they are down to two at this time. Chief Turner also asked for permission to let children of the volunteer fire members to ride on the fire trucks at the 4th of July parade. The fire department has been invited to participate in the Gaudy Maude Festival with Star Valley Ranch. Councilman Bartleson made the motion that the children be allowed to ride on the trucks with a signed release form from the parents. Councilman Titensor seconded the motion.

Alesia Winters reported for the Thayne Ambulance Board. Alesia informed the council that they were getting ready to send out the donation letters. She also asked permission for the children of the EMT’s to be allowed to ride in the ambulances at the 4th of July parade. Councilman Bartleson said that he would amend his motion to include the EMT children also. Alesia talked with the council about fund raisers. She expressed her concern over spending a lot of time and effort with fund raisers and not getting the community support. Councilman Bartleson suggested that they might try a cheese cook off in the fall. Alesia suggested that they might have a concession stand at the fireworks display. Councilman Titensor suggested that they might try to have a community picnic. Councilman Titensor stated that when he was in the fire department that they had picnics and it really was a good event. Mayor Aullman thanked both the fire department and the EMT’s for their efforts with the community.

Next on the agenda was the hearing for Hub’s Smokin-Grill Restaurant Liquor License. Clerk Jensen reported that she had not received any written comments regarding the license. Mayor Aullman asked if there were any comments from the audience. With no further comments regarding the restaurant liquor license, Councilman Titensor made the motion to approve the restaurant liquor license for Hub’s Smokin-Grill. Councilman Luthi seconded the motion. Councilman Bartleson voted against the license. Mayor Aullman stated that he was for granting the license. The restaurant is allowing customers to bring in their own alcohol to have with their dinner. The restaurant liquor license will give the restaurant owners total control on how much they allow their customers to drink. Councilman Titensor stated that he voted for the restaurant liquor license for just that reason. Motion approved.

Mayor Aullman tabled the fire department retrofit bid opening. Mayor Aullman informed the audience that the council was discussing having some major addendums added to the project. Mayor Aullman stated that the town will give everyone the opportunity to review the project and change their bids. All bids will be returned to the contractors without opening them. Mayor Aullman asked the council if they agreed with returning the bids and not opening them. Councilman Titensor commented that he felt that the town needed to design exactly what we wanted and rebid the project.

Don Snider addressed the council next. Mr. Snider thanked the council for letting him come to the meeting and explain his side of the story regarding the problems with Star Valley Inn. Don reviewed with the council the history of the two parcels of property and the ongoing dispute over the easement between the properties. After a lengthy discussion regarding the easement, Council discussed with Don the problems with the existing parking at Juan’s House of Tacos. Don presented a plan for the council to review regarding the new parking plans. Mayor Aullman suggested that they use signage to help people know where to park. Councilman Bartleson asked them if they had considered taking down the old garage. Councilman Bartleson felt that they could have a one way in with the existing easement and use the north side of the restaurant as a one way out. Don said that they might consider this at a later date. Don has things stored in the garage and he stated that there is an old gas tank underneath the garage. Don was going to check with the state to see the rules for removing gas tanks and also the cost to see if it were even feasible.

Faban Hansen expressed his concerns regarding the drainage and the parking. Faban stated that they did not have enough room for the amount of parking they are required to have. Don stated that he would take care of putting in a new drain on his property. Mayor Aullman asked Don to be careful where the water is draining with the man made slope on his property. Faban expressed his concerns over liability issues with the easement. Faban stated that they needed to create their own access and not use the easement. Mayor Aullman stated that this was not an issue for the council to decide. Mayor Aullman asked Don to move forward with the parking plans. Mayor Aullman asked Don to lay out the parking lines and then notify the council and they would come and inspect it to make sure that it meets the town’s regulations. Councilman Bartleson made a motion to approve the parking with an on sight review. Councilman Luthi seconded the motion. Don requested that the council take away the contingency that was put on Juan’s House of Taco’s business license. Mayor Aullman stated that when the parking issue is resolved there will be no problems with issuing Juan a new business license for the next fiscal year.

Terry Merica addressed the council over her concerns regarding the old Holdaway School. She questioned the town regarding whether they had done a feasibility study on the school regarding demolition costs and costs for remodeling the school. Terry expressed her opinion that the town should not acquire the old school. Terry also stated that the Town of Thayne should not be going into the rental business. As a business owner of five commercial units, she did not feel that the town should take away from her businesses. Mayor Aullman informed Terry that the town did not have any intention of taking away from main street businesses. If we acquire the school, the town will only be renting it to the Child Development Center, Lincoln Self Reliance and the Lincoln County Library. Mayor Aullman also stated that the school will be used for our recreation programs. The Town of Thayne would have to get rid of most of their recreation programs if we don’t get the school. Mayor Aullman commented on the lack of space at the child development center and the percentage of children they are not able to help because of this. Mayor Aullman also stated that the young people in our town are our best investments and the best place to continue with these programs is at the old school. Mayor Aullman also informed Terry that we will be doing more studies if we receive this grant and that the town will walk away from this project if we feel that it isn’t feasible. The council wanted to make the old school a productive part of our community and not an eyesore.

Next on the agenda was the first reading for the Meadows Annexation. Clerk Jensen informed the council that she had received a letter from Jim Sanderson stating his concerns regarding the annexation and voting against it. Mayor Aullman commented that most of Mr. Sanderson’s concerns will be solved with a new water storage tank. Robert Hood, from Sunrise Engineering, stated that the town does have the water supply that is required for the first phase of the Meadow’s subdivision. The problem that Bear Hollow is having at this time with their water pressure is their individual boosters. Robert Hood also commented that Bear Hollow should have a booster for their whole subdivision and not individual boosters. Robert stated that their problems could be solved by having Bear Hollow make a deal with Meadows and tie onto Meadow’s new booster. They would have plenty of water pressure than. Council reviewed the inspections that are not finished with the Meadows subdivision. Ron Coleman stated that there are still a lot of problems that will ultimately affect our system if we do not get the inspections done. Ron expressed his views that they have tied onto the town’s water and sewer systems and they need to make sure they are compliant with the rules. Mayor Aullman and the Council asked Robert to send a letter to Meadows giving them a deadline for their final inspection. Council asked Robert to give them a punch list of items that needed to be corrected by June 1st, 2010. If Meadow’s fails to meet this deadline, they will be shut off from town services. Robert asked if the town had signed a developer’s agreement. Mayor Aullman stated that the town will not sign any agreement until they pass the inspections. Council also tabled the first annexation reading until they pass their final inspection.

Council reviewed the TIPS program and what was required in other communities that have adopted this program. Aleisa Winters was in attendance and informed the council that the training took four to five hours every three years. The class cost $50 a person. Alesia also informed the council that the classes can be taken online. Clerk Jensen informed the council that she had sent letters to all the liquor license holders in the Town of Thayne to attend this meeting and give their input. Council discussed the percentage of employees who would be required to have the TIPS training. Council also discussed making this training a requirement before the liquor license holders can renew their licenses each year. Councilman Titensor made a motion that each councilman will review the sample policies and be ready to establish a TIPS Ordinance at the next council meeting for the first reading. Councilman Luthi seconded the motion.

Star Valley Ranch was represented by Councilmember’s Al Redlin and Edwin Koch. Councilman Koch had sent a letter back to the Town of Thayne regarding the EMS contract with the town and Star Valley Ranch. Mr. Koch thanked the volunteers and stated that they had no issue with the fire department and the ambulance service. Star Valley Ranch does have a problem with the money that the Town of Thayne is asking for to renew the contracted services. Mr. Koch talked with the council about Star Valley Ranch and the reductions in their budget year incomes. He stated that what the Town of Thayne was asking for was not logical. Councilman Bartleson asked Mr. Koch if Star Valley Ranch had considered that they were a higher risk because of the larger number of houses, timber around the houses and etc. Mr. Koch stated the number of calls that were at Star Valley Ranch last year. Mayor Aullman commented that they were not paying for the number of calls that were responded to. The contract was for the availability of having these services. Mayor Aullman expressed his opinion that you cannot short circuit these services because of declining services, safety should come first. After a discussion regarding the contract, Mayor Aullman asked Councilman Titensor to meet with Mr. Koch and Mr. Redlin to see if both entities could come up with an agreement for emergency services.

Robert Hood represented Sunrise Engineering. Robert reviewed the cleanup process for the water meter project. Robert informed the council that Mayor Aullman and Ron Coleman had met with Johnson Construction. Mayor Aullman offered to let them start their cleanup process as early as the weather permitted to help the residents of Thayne. The days used for cleanup will not go against the remainder of the days that are left for the meter project. Robert stated that he had informed them that they could do everything that was left except put in new meters. Council asked if they were putting in sod and Robert told them that the contract only required seeding of grass. Robert also reminded the council that there is a one year warranty on the entire project that will start at the completion date of the entire project. Robert informed the council that Mike Hackett did a state inspection on the water meter documents Monday, May 10th. The Town of Thayne passed the audit and everything looked fine. Council reviewed the impact fees for water and sewer. Council agreed on the fees but decided that they could be simplified by renaming the items. Instead of calling them new improvements impact fees, buy-in impact fee and connection fee they will be called a hook up fee. The developer or land owner will pay half the fee at plat approval and the other half at connection of the water or sewer. This fee does replace the old impact fee of $2,500. If you are outside city limits and are using town water and sewer, the connection fees will be doubled as well as user fees. Mayor Aullman informed the council that we already have the stipulation that we can charge double the user fees if they are outside city limits but the ordinance does not state that we can charge double for hook on fees outside of city limits. Councilman Bartleson made the motion that we change the ordinance to read that we can charge double for hook on fees outside of city limits on first reading. Councilman Luthi seconded the motion.

Ron Coleman reported to the council on maintenance issues for the Town of Thayne. Ron reported that we are having a litter problem with beer cans in town. Ron said that we have garbage containers by both Dad’s Bar and Pine’s Bar. Larry Parker, owner of Star Valley Sleep Center, told Ron that he has to go around his property each morning and pick up all the beer cans that have been thrown down or put in window sills. Councilman Bartleson stated that we have an ordinance to enforce this. Council asked Ron to speak with the business owners and ask them to try and help with this problem. Ron handed a copy of a proposal for a tri pod for the council to review. Councilman Bartleson made the motion to purchase the tri pod. Councilman Titensor seconded the motion. Ron informed the council that we had purchased a striper for town use. Ron will get the walking path painted as soon as possible. Ron also informed the council that Cliff did not pass the water test.

Clerk Jensen was asked to contact H.K. regarding Roberts Street. Clerk Jensen was also asked to talk to Robert Hood regarding water easements.

Mayor Aullman reported to the council that he is still working on purchasing fire arms for the police department. Council discussed having the officers do random night patrols.

The bills were reviewed by the council. Councilman Titensor made a motion to pay the bills. Councilman Luthi seconded the motion.

Councilman Bartleson had letters and costs not to exceed from Surveyor Scherbel regarding surveying that needed to be done for the Town of Thayne. These projects include boundary adjustment for the sewer land, annexation plat to include the rest of the sewer property into the town, and the dedication of Roberts Street. Council agreed to have Surveyor Scherbel do the projects.

Ordinance # 258 regarding the General, Water, Fire Department, Thayne Ambulance, and Severance accounts for fiscal year 2010-2011 was passed on first reading. Councilman Titensor made the motion to pass Ordinance #258. Councilman Luthi seconded the motion.

Ordinance # 259 regarding the Sewer account for fiscal year 2010-2011 was passed on first reading in a motion made by Councilman Bartleson. Councilman Luthi seconded the motion.

Ordinance # 260 regarding the mill levy for the Town of Thayne for fiscal year 2010-2011 was passed on first reading by Councilman Bartleson and seconded by Councilman Titensor.
