Thayne Town Council Meeting
June 9th, 2010

Present:  Mayor Don Aullman.  Councilmembers; Lorell Woolley, Terry Titensor, Jim Bartleson.  Clerk Joan Jensen.

Mayor Aullman called the meeting to order.  Mayor Aullman asked Joe Hewerd to lead the audience in the Pledge of Allegiance.

Mayor Aullman called for approval of the previous read minutes of May 13th, 2010.  Councilman Titensor made the motion to approve the minutes.  Councilman Bartleson seconded the motion.

Chief Turner was first on the agenda.  He informed the council that he had attended a class regarding the lighting of the fireworks for the 4th of July.  Chief Turner stated that it was a very informative class and would help us create a better fireworks show for the community.  Chief Turner also asked the town to make sure that the fire department was covered with Wyoming Worker’s Compensation when they are helping with town events and fire department fund raisers.  Clerk Jensen will check with the worker’s compensation department.  Chief Turner also asked the council for approval on an Eagle Scout project.  Jackson Hokanson approached the fire department regarding putting up a new sign for the fire station and a flag pole with lights for an Eagle Scout project.  Jackson felt that it would cost around $1,000. 00 for the entire project.  The fire department approved the project with the funds coming out of their donation account.  Chief Turner also asked the council for approval regarding the Eagle Scout project.  Councilman Titensor made the motion to approve the Eagle Scout Project and Councilman Bartleson seconded the motion.  Chief Turner also informed the council that they are getting ready to send out their donation letters.  The donation letters are asking for funds to establish a wellness program for their volunteer fire fighters and also an upgrade on one of their pumps. Councilman Titensor asked about the requirements for driving the new rescue truck and if the volunteers needed to have a CDL license.  Chief Turner responded that with the weight limit of the truck that it was his understanding that you needed a CDL license to drive it.  Chief Turner also stated that there are only two firemen that are qualified to drive the truck at this time.  Councilman Titensor and Councilman Bartleson both expressed their opinions that we needed to be legal when operating the truck and that we needed to get everyone that would be driving the truck to get a CDL license.  Chief Turner informed the council that he was nominated for VFW State Fireman of the year.  Chief Turner will be traveling to Casper next week for the award ceremony.  Council congratulated him on this award.

EMT’s was represented by Joe Hewerd.  The EMT’s have scheduled July 23rd as their movie at the park fund raiser.  Joe informed the council that the EMT’s will be helping at the Maude Gaud horse shoe tournament.  Councilman Bartleson asked Joe if the money that was donated by the businesses was given to the EMT’s.  Joe responded that he was not sure.  Councilman Bartleson stated that he would check with Star Valley Ranch regarding this.  Joe also informed the council that they are having trouble with a garage door.  Joe said that the problem was not happening all the time so he thought that they just needed to adjust the door.  The EMT’s will work on this at their training meeting.  Councilman Bartleson asked Joe to let Clerk Jensen know by Friday if they were still having problems with the door.  Council expressed their appreciation to the EMT’s and all that they do for the community.

Joe Hewerd was next on the agenda.  Joe asked permission from the council to put his snow shack on town property during the ball games and soccer games.  Councilman Titensor made the motion to allow Joe to run his snow shack on town property during the ball games.  Councilman Woolley seconded the motion.

Ordinance # 261 concerning the water and wastewater connection fees was approved on second reading.  This ordinance allows for the town to charge double price for water and sewer hook on fees outside the city limits.  Councilman Bartleson made a motion to approve Ordinance #261 on 2nd (second) reading.  Councilman Woolley seconded the motion.

Council discussed the TIPS program.  Discussion was on who should be required to have this certification.  Mayor Aullman stated that he definitely felt that the owners of the liquor license should have the training.  Councilman Titensor commented that he felt that anyone who was serving liquor should be required to have this training.  Council discussed that the employees should have this training within thirty days of employment and suggested that the owners might suggest this as a pre-employment qualification for anyone who is serving liquor to clients.  Clerk Jensen asked the council how the town was going to make sure that the employees were certified in the TIPS program.  Councilman Titensor suggested that it would be the owner’s responsibility to let the town know of their certification and if they don’t have the certification, than the town will penalize them with a fine.  Council also discussed that they would have to show their certifications before their liquor licenses were renewed.  Council asked Clerk Jensen to send the liquor license holders a copy of the ordinance and let them respond before the second reading.  Councilman Woolley moved to approve Ordinance # 262 on 1st (first) reading regarding the TIPS program for serving alcohol.  Councilman Titensor seconded the motion.

Councilman Titensor reported to the council regarding his meeting with Star Valley Ranch and the EMS contract with the Town of Thayne.  Council discussed the contract and also the fire trucks that are being housed at Star Valley Ranch.  Councilman Titensor informed the council that by having a satellite station at Star Valley Ranch that every resident there should be able to qualify for an ISO rating of six.  This is a significance saving to each land owner.  Councilman Titensor stated that he talked to them regarding administrative costs, insurance, equipment and maintaining costs related to the fire department and EMT’s.  Councilman Titensor also informed the council that Star Valley Ranch does not want to pay anymore for these services than they did last year.  Star Valley Ranch is hurting just like the rest of the towns.  Star Valley Ranch expressed their concerns over a lot of foreclosures and unpaid assessments.  Councilman Titensor informed Star Valley Ranch representatives that the Town of Thayne is not trying to overcharge them.  The town feels that we are providing them EMS services for a pretty minimal amount.  Council discussed the dollar amount and having a yearly contract or a contract for five years.   Bob King was present and he stated that it was illegal for Star Valley Ranch to sign a contract for five years.  Bob stated that they cannot sign a contract for longer than their term of office.  Councilman Titensor made the motion that the Town of Thayne contract with Star Valley Ranch for EMS services for 4 (four) years with a dollar amount of $66,000 the first year and a 3.5% increase for the next three years.  Councilman Bartleson seconded the motion.

Robert Hood represented Sunrise Engineering.  He informed the council that Johnson Excavation is doing clean up around the town.  They are pouring sidewalks and working on clean up with the meter pits.  Robert informed the council that Johnson Excavation would like to hold off on the rest of their meters until July 1st because of the bad weather we have been experiencing.  Johnson Excavation will bring in a large crew to finish off the project and meet their deadlines.  Council agreed that they were willing to wait until July for the project to be completed.  Clerk Jensen reminded Robert that we still have not heard anything regarding the billing software that we will need for the meters.  Robert also informed the council that he had visited with Butch Roberts regarding the water easement.  Robert invited Butch and Jill to come to the meeting tonight to visit with the council regarding the water easement.  Mayor Aullman informed Robert that the town’s attorney sent a letter to Meadow’s regarding their subdivision.  The letter stated that they needed to pass the inspection list with their water and sewer lines by July 1st, 2010 or they would be disconnected from the town’s water.  Mayor Aullman asked Robert to have a punch list prepared for them to review regarding the engineering inspections.

Butch and Jill Roberts expressed their concerns regarding the water line that runs through their property by the canal to their home.  Butch and Jill explained to the council that the town never had an easement for this water line.  Council explained that they would like to have an easement for the entire line.   Jill stated  that they would never give the town and easement across their property.   Council asked Butch what they planned on doing when the water line needed to be replaced and that they would probably be looking at replacing the line in the near future.  Council discussed with the Robert’s that they could bore under Hemmert Street and provide a new water connection or put a meter on the old water line and they would be charged for all the water that was used from that point to their home.  The Robert’s would be charged for all the holes that are leaking in that old line and be responsible for the upkeep of that line.  Council discussed the different options they had regarding the water line and the Robert’s agreed that they would rather have a new hookup.  The Town of Thayne will provide the water line to their home and also make sure that it is as good as better with the cleanup process.  The old water line will be abandoned.  Councilman Bartleson made the motion that the Town of Thayne cut the sod and lay the water line to the house.  The town will also temp the ground and replace the sod as good or better.  Councilman Titensor asked if the Town of Thayne was setting precedence by doing this for the Robert’s.  Council discussed that the town is only doing this for the water developments that the Robert’s put in several years ago.  Butch and Jill stubbed in five water connections at their own expense several years ago so the town wouldn’t have to dig up Hemmert Street.  They have used three of these connections and have two left.  Councilman Woolley seconded Councilman Bartleson’s motion regarding the water line for the Robert’s.

Mayor Aullman informed the council that he attended the Wyoming Business Council meeting that was held at Riverton on June 3rd to review the town’s Business Facilities Grant for the old school.  Mayor Aullman stated that the council approved our grant with positive acceptance.  The final step for the grant will be the State Lands and Investment Board meeting that will be held June 17th, in Cheyenne.  Mayor Aullman will be attending the meeting.

Ron Coleman submitted a maintenance report to the council.  Ron explained to the council that he has been working with DEQ regarding the paperwork for the sewer discharge permit.  DEQ was still in the mindset that the Town of Thayne was having spray fields.  They asked Ron why we were doing all the unnecessary testing.  DEQ is reviewing our sewer permit at this time.  Ron explained to the council that they may require the town to install a drain pipe into Flatcreek just so that we can determine that we do not have a discharge each month.  They may also require us to have more monitoring wells.  Ron informed the council that we will just have to wait for DEQ to reply back to us.  Ron also commented that they had expressed that the Town of Thayne would be putting themselves in jeopardy if they were to trade off some of the sewer land.  Ron asked them to send us a letter stating this but they stated that legally they could not give us legal advice.  Ron submitted copies of sewer land maps to each member of the council and discussed the land swap that they were considering doing with Mr. Lainhart after the surveys were completed by surveyor Scherbell.  After a lengthy discussion, council asked Ron to mark the measurements on the land for them to go and review before a decision is made.  Council also asked Ron about the grease traps and where we were at regarding having them all installed and completed.  Ron said that he was going to give each business a letter for them to sign and turn into the town when they were completed.  Ron will then inspect the grease traps at each business to make sure that they meet the town’s requirements.

Councilman Woolley submitted quotes for having electricity wired in at the new recreation storage shed.  No action was taken at this time.

Mayor Aullman reported to the council that he and Councilman Woolley had inspected the parking area that was laid out by Don Snider.  Mayor Aullman also informed the council that the motel property may be reverted back to Don Snider.  Council discussed that a letter needs to be sent to Mr. Snider requiring him to improve the parking at Juan’s House of Taco’s even if the property reverts back to the original owner.

Mayor Aullman also informed the council that there is a class being offered at Western Wyoming College for removing toxin materials from buildings.  Mayor Aullman would like to have Ron Coleman attend the class.  Councilmen were all in agreement that it would be a benefit to the town to have him attend the class.  The class will be held June 24th at Rock Springs.

Council reviewed the bills for payment.  Councilman Titensor made the motion to pay the bills.  Councilman Bartleson seconded the motion.

Council discussed increasing the cost of business licenses’ from $25 to $50 a year.  Councilman Titensor made the motion to increase the cost of a business license to $50 on first reading.  Councilman Bartleson seconded the motion.

Council discussed increasing the cost of building permits from $10 to $25.  Councilman Bartleson made the motion to increase building permits to $25 on first reading.   Councilman Titensor seconded the motion.

Ordinance #258 regarding the Town’s General, Water, Fire Department, Thayne Ambulance, Recreation, and Severance Funds was passed on 2nd (second) reading.  Councilman Bartleson made the motion to pass Ordinance # 258.  Councilman Titensor seconded the motion.

Ordinance # 259 regarding the town’s sewer funds was passed on 2nd (second) reading in a motion made by Councilman Titensor.  Councilman Woolley seconded the motion.

Ordinance # 260, providing for the Mill Levy for the Town of Thayne for the fiscal year 2010-2011 was passed on 2nd (second) reading in a motion made by Councilman Bartleson.  Councilman Titensor seconded the motion.

Third and final reading of the budget for fiscal year 2010-2011 will be held June 23rd at 6:30 p.m.
